
Guanajuato, Gto., January 19, 2016. The University of Guanajuato (UG) received the ex-Rector from the University of Salamanca (Spain), Dr. Ignacio Berdugo Gómez de la Torre, who gave the conference "Problemas actuales del Derecho Penal. Una reflexión politico criminal" (Actual problems of Criminal Law. A criminal political thought), in which he proposed how the country's historical, economic, political and social context influences directly in the construction of this branch of law.
Dr. Berdugo is considered a referent in the construction of European criminal law, said UG's General Rector, Dr. Luis Felipe Guerrero Agripino, who was a special guest in the event, where he handed a recognition award to the Spanish jurist.
In his exposition, the professor from the University of Salamanca said that the great problem of Criminal Law is the relationship between effectiveness and guarantee, and after analyzing factors such as internationalization, new technologies and scientific development, he considered one of the things to do is the relationship between ethics and criminal law in a democratic state.
"Criminal Law is tailored for the society it generates in", said Dr. Berdugo Gómez de la Torre, who questions if the old legal tools work to address the new problems they face. As for the role of academics in this thought, said that it is their job to propose doubts because "societies who don't doubt, are totalitarian".
In his analysis he highlighted that it is a fiction to believe that Criminal Law is neutral that is why it is necessary to consider elements such as the legislator's and interpreter's prejudices. He also warned the listeners that good laws are a condition for things to work, but not a guarantee.
After the exposition, Dr. Berdugo answered the doubts in the auditorium which was filled with members of the university community such as UG's Pro Vost, Dr. Héctor Efraín Rodriguez de la Rosa; University Attorney of Academic Rights, M. Jesús González García; Director of the Division of Law, Politics and Government, Dra. Teresita de Rendón Huerta Barrera and the Director of the Department of Law, Dr. Eduardo Pérez Alonso.
Also present were the Executive Director of Universia, Dr. Arturo Cherbowski Lask; Director of Institutional Relations of Universia, M. Jorge de la Torre Rosas and the City Clerk from the City of Guanajuato, Dr. Carlos Torres Ramírez.
